Commissioner of Oaths

Some documents can be “Commissioned” instead of Notarized. Commissioners of Oaths are persons empowered by the Province of Ontario to administer and witness the swearing of oaths or declarations. If this is required, it will usually be indicated on the document around the signing area. Some examples are Affidavits or Statutory Declarations.

The Commissioner of oaths only certifies that the required oath/affirmation/declaration has been properly administered and not the truth of the statements contained in a document; which remains the responsibility of declarants or deponents themselves. This requires that the deponent be physically present before the Commissioner of oaths and the Commissioner of oaths being satisfied about the authenticity of the deponent’s or declarant’s identity and signature before certifying the document.

Usually, for Notarization/Commissioning, you will prepare these documents in full before you meet with the Notary/Commissioner for Oaths and pay only the signing/stamping fees.

If you want the Affidavit/Statutory Declaration prepared by TIO Law Office, it will be an all-inclusive fee of $99 plus HST for each document. Please note that TIO Law Office will not provide you with legal advice regarding the document(s), or their contents.

Certified True Copy

In many situations you may be required to provide an important document such as your passport, birth certificate, identification card or academic records for an application or as a supporting document. Rather than submitting the original document, in most cases a certified true copy (or “notarized copy”), will be sufficient.

If you are required to provide a certified true copy of an original document such as your passport, birth certificate, identification card or academic records for an application or as a supporting document, a Notary Public is required in most Canadian provinces to certify that the original you present is a true copy of the original.

The Notary will certify a photocopy of your original document as being a true copy of the original by affixing a signature, seal and statement to that effect on the copy itself.
